USER AGREEMENT |
ANY PERSON OR ENTITY ("User") ACCESSING THE www.indiademocracy.org WEBSITE OR ANY OF THE INFORMATION CONTAINED HEREIN AGREES TO AND IS BOUND BY THE FOLLOWING TERMS AND CONDITIONS OF THIS www.indiademocracy.org USER AGREEMENT ("Agreement"):
www.indiademocracy.org is an offering of V-Empower Inc. and is available free of charge.
1) The owner of the www.indiademocracy.org website provides the content, information, software, and services "AS-IS", with no warranty expressed or implied, including warranties of fitness for a particular purpose or warranties of merchantability.
2) In consideration for the Service, member agrees to provide www.indiademocracy.org current, complete, and accurate registration information (the "Registration Data") as prompted to do by the Service and to maintain and update this information as required. Member Information collected for www.indiademocracy.org registration purposes will not be disclosed to any third parties in connection with marketing services.
Membership is non-transferable
All information provided by a Member is strictly confidential. www.indiademocracy.org will not intentionally monitor or disclose any private information unless required by law enforcement agencies, regulation or court order.
3). www.indiademocracy.org does not discriminate on the basis of age, gender, race, religion, caste, class, lifestyle preference, or nationality.
The following is a non-exclusive list of actions and content that are not permitted on IndiaDemocracy:
- Material that is an expression of bigotry, racism, or hatred based on age, gender, race, religion, caste, class, lifestyle preference, and nationality.
- Material that defames, abuses, or threatens others.
- Material that advocates illegal activity and opposed to law.
- Material that contains obscene content
4) Members are solely responsible for everything contained in their IndiaDemocracy accounts.
Views expressed by members are their individual views and www.indiademocracy.org is not responsible for any such views, expressions, ideas, comments, statements and content of the same.
www.indiademocracy.org does not review the content of a posting in any way before they appear on the site.
Members can be held legally liable for the content they post and may be held legally accountable if their posts include defamatory comments or material protected by copyright, trademark, patent or trade secret law without the permission of the author or owner.
5) The user agrees to indemnify and hold harmless www.indiademocracy.org, its employees, directors, officers, agents and their successors against any and all liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising from or in connection with the content of the user's post including any claim of defamation, violation of rights of privacy or publicity, loss of service by other members and infringement of intellectual property or other rights.
6) Any material protected by trademark, service mark, patent or copyright registration may not be placed on the Site or the Membership area without the express permission of the author or owner of the copyright on that material.
In the event that www.indiademocracy.org receives a complaint that the content posted infringes intellectual property rights or are otherwise unlawful, IndiaDemocracy shall request written substantiation of the complaint from the complaining party.
As such, www.indiademocracy.org will require authentic proof of ownership in the form of a trademark, service mark, patent or copyright registration and will take such steps that it believes to be appropriate under the circumstances.
7) The user agrees that the use of www.indiademocracy.org website and any information obtained from this site is at the sole risk of the user. User hereby waives all claims against the owners of www.indiademocracy.org, V-Empower. Inc., any of their affiliates, officers, directors, employees, agents, and representatives ("www.indiademocracy.org"), and any of www.indiademocracy.org's suppliers or programmers.
User agrees to defend, indemnify and not to hold www.indiademocracy.org liable for damages that may be incurred by www.indiademocracy.org, including attorney's fees, related to User's use of www.indiademocracy.org's website or User's use of any information obtained through User's use of www.indiademocracy.org's web site.
8) www.indiademocracy.org are not responsible for websites that are accessed by a user from www.indiademocracy.org's web site - by link, frame, or any other means ("Linked Site").
Any link, frame, or any other means by which a user accesses any Linked Site provided by www.indiademocracy.org or otherwise on www.indiademocracy.org's website does not constitute www.indiademocracy.org's endorsement, recommendation, or acceptance of any responsibility for the content of that Linked Site or the operators of that Linked Site.
www.indiademocracy.org does not endorse in anyway any contents of the expression of the members on its Postings. Please therefore verify the veracity of all information on your own before undertaking reliance and action thereupon.
www.indiademocracy.org shall not be responsible or liable for any consequential damages arising on account of the member relying on the contents.
www.indiademocracy.org shall not be liable for any indirect, incidental, special or consequential damages or for interrupted communications, lost data or lost profits arising out of or in connection with this service, even if www.indiademocracy.org has been advised of the possibility of damages.
9) User agrees not to attempt to damage, hack, crack, reverse-engineer, or otherwise interfere (collectively, "Interfere") with www.indiademocracy.org's website in any manner.
If the user in any way INTERFERES with www.indiademocracy.org's website, User agrees to pay all damages incurred by www.indiademocracy.org, including any consequential damages. The user further agrees that the measure of damages will be the highest estimate provided by www.indiademocracy.org.
User's Interference with www.indiademocracy.org's website relieves www.indiademocracy.org of any of its contractual or other legal obligations to the User, including www.indiademocracy.org’s obligations under its Privacy Policy.
www.indiademocracy.org will cooperate with the authorities in prosecuting any User who interferes with www.indiademocracy.org's website, attempts to defraud www.indiademocracy.org, or any other parties through User's use of www.indiademocracy.org's website or services.
10) V-Empower reserve the right to refuse any or all services to any User for any reason, at any time, at www.indiademocracy.org's sole discretion. User agrees that www.indiademocracy.org may block its IP address or addresses at any time, and at www.indiademocracy.org's sole discretion, thereby disallowing User's continued use of www.indiademocracy.org's website.
11). Users agree to respect the privacy and confidentiality of other members. Members acknowledge their right to use the service is personal to them, unless expressed otherwise. Member agrees not to resell or make any commercial use of the Service without the express consent of www.indiademocracy.org and its owners V-Empower Inc.
Member will be held liable for any unauthorized use of their account by any third-party. Member is entirely responsible for maintaining the confidentiality of their password and account.
12) The User Agreement, Privacy Policy, and other terms of service may be changed without notice by V-Empower, and the use of www.indiademocracy.org's website or services constitutes agreement with and acceptance of any such changes.
13) www.indiademocracy.org reserves the right to terminate/suspend Membership and any and all information, communications, posts, or blogs at any time, without notice.
www.indiademocracy.org may also terminate Membership and delete any and all information, communications, posts, or blogs for online conduct that www.indiademocracy.org deems harmful to other Members, the business of www.indiademocracy.org or other third-party information providers.
14) www.indiademocracy.org reserves the right to release current or past member information that www.indiademocracy.org believes is in violation of the terms of service or page content guidelines, or used to commit unlawful acts, or if the information is subpoenaed, and/or if www.indiademocracy.org deems it necessary and/or appropriate.
15) www.indiademocracy.org provides this service with the best possible intentions and is not liable for any unforeseen event such as interruptions, failures, delays in the delivery of content or services available within the Membership area.
16) If any part, term, or provision of this Agreement shall be held by a court of competent jurisdiction to be illegal, unenforceable, or in conflict with any law of central, state, or local government having jurisdiction over this Agreement, the remaining portions or provisions shall still remain valid and continue in full force and effect.
17) This Agreement shall be governed and construed in accordance with the laws of India, without resorting to any jurisdiction's conflict of laws, rules or doctrines. Any claim, action, suit, or proceeding (collectively, "Claim") between V-Empower and the User that arises from or relates to this Agreement shall be brought and conducted solely and exclusively with a Court of competent jurisdiction in India.
18) www.indiademocracy.org reserves the right to take any or all action it may deem appropriate, in its sole discretion, with respect to violations or enforcement of the terms of this Agreement, and expressly reserves all rights and remedies available to V-Empower at law or in equity.
19) www.indiademocracy.org expressly disclaims all warranties of any kind, whether express or implied. www.indiademocracy.org makes no warranty that the services will meet the member's requirements, or the services will be uninterrupted, timely, secure, or error free; nor does www.indiademocracy.org make any warranty as to the results that may be obtained through the service or that defects in the software will be corrected. Member understands and agrees that any material and/or data downloaded or otherwise obtained through the use of the service is done at the member's own discretion and risk and member will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data.
No advice or information, whether oral or written, which the member obtains from www.indiademocracy.org or through the service will create any warranty not expressly made herein.
20) www.indiademocracy.org does not endorse in anyway any content, views or comments made by members on their Posts. Please therefore verify the veracity of all information before undertaking reliance and action thereupon.
21) V-Empower Inc. or www.indiademocracy.org will not be responsible or liable for any consequential damages arising on account of the member relying on the content. www.indiademocracy.org will not be liable for any indirect, incidental, special or consequential damages or for interrupted communications, lost data or lost profits arising out of or in connection with this service, even if www.indiademocracy.org has been advised of the possibility of damages.
